Terms & Conditions
If you make your reservation via a travel agent, or other third party, then you have a separate legal relationship with that party and B&J Diving Centre Snd. Bhd. has no liability for any acts or omissions of such party including their observance of your data protection rights.
When you make your reservation, you will be also deemed to have read, understood and accepted the terms and conditions for using the TDR website (which shall mean www.tiomandiveresort.com or any related TDR web pages accessible from it) and any relevant terms and conditions shall be deemed to be incorporated into your reservation and the accommodation agreement with TDR. RESERVATIONS PROCEDURE AND POLICIES
The TDR website enables you to check the accommodation offerings and availability of TDR rooms or Dormitory beds and then submit an online reservation request. On completion of the reservation process the Reservations Facility will transmit an online confirmation of your reservation. A reservation is only valid when a reservation number has been issued.
Depending on the type of booking, full payment may be required at the time of booking. We currently accept payment by Visa or Mastercard credit/debit cards, Paypal, Stripe or online bank transfers. The available payment options are displayed during the booking process on our Website. A payment processing fee may apply.
Once your booking has been successfully completed, a confirmation in respect of each booking will be sent to the email address provided by you in your registered account (“Booking Confirmation”). If you do not receive your Booking Confirmation(s) within twenty-four (24) hours from the time of booking, please contact us at email@example.com
You MUST produce your Booking Confirmation(s) upon check-in at the Hotel, together with your original valid photo identification document (national registration identity card, passport, driver’s licence or other identification card).
At all times during the booking process, you will be advised to ensure the accuracy of your booking details (guest details, stay dates, room types, room rates, number of guest(s). TDR will not be responsible or liable for errors in booking details. We will not be under the obligation to refund or modify the booking should you fail to give us reasonable notice of any error in the booking details prior to the check-in date.
Bookings are accepted subject to room availability.
2. Room Rates
Room rates shown on our Website are charged on a per room per night basis. Our prices may be based on a ‘dynamic pricing’ model and might fluctuate depending on supply and demand. The price of your reservation will be confirmed at the time of booking and shall not be amended in case of rate fluctuation between the date you booked your stay and your arrival.
Room rates and details are correct at the time of publication and are subject to change without notice.
We reserve the right to correct errors in both advertised and confirmed prices. We will do as soon as we become aware of the error.
3. Tourism Tax (TTx) & Sustainability Fee
Pursuant with the Tourism Tax Act 2017, a charge of MYR 10.00 per room per night Tourism Tax (TTx) will be levied on tourist(s) and non-resident guest(s). Malaysian citizens and permanent residents with MyPR cards are exempted from the payment of TTx. TTx is not included in the room rate and will be collected at check-in.
The state of Pahang has further implemented a Sustainability Fee of MYR 3.00 per room per night, which is payable directly to us upon arrival.
4. Payment & Room Deposit
It will be necessary for you to provide credit card details or make payment via PayPal, bank transfer or other payment method as stated on the check-out page to secure a room reservation.
Upon check-in we will require a deposit payment of MYR 200.00 per room which shall only be used as a security in case of damaged items or smoking inside the room.
5. Cancellation Policy, Refund Policy, Amendments & Unused Services
You should make any cancellations or amendments at least 14 days prior to your arrival via email to firstname.lastname@example.org.
- You can cancel free of charge until 14 days before arrival
- You will be charged the total price of the reservation if you should cancel in the 14 days before arrival.
- No refund on payment shall be given and payment in full must be made if not done so already, should you decide to
- Shorten your stay
- Arrive later than your initial booking date
- No refund on payment shall be made for unused services, i.e. if a guests decides not to utilize a booked room, dive course, fun dive or other service. Full payment for any booked service is due prior to departure, weather fulfilled or not.
6. Minimum Stay
A minimum stay of 2 nights at TDR is required if you come of a weekend, a minimum of 3 nights is required if you come over a public holiday.
There is no minimum stay requirement for B&J Dormitory.
7. Check-in, Check-out and Early Departure
Check-in time is 2:00pm, check-out time is 12:00pm.
Early check-in is acceptable if the booked room(s) are available, which can only be confirmed upon arrival.
Late check-out is possible only if the room is not booked by other guests and a late check-out fee may apply.
Booked rooms will be held for check-in until 9.00 am the following day of the scheduled check-in date, after which the booking will be deemed cancelled upon no-show.
There is no refund and full payment for the entire booked duration is due should you decide to check-out earlier than planned.
8. COVID-19 SOP & Terms if a guest contracts Covid at our premises
Your safety is important to us, and we therefore request all our guests to conduct an RTK Antigen Self-Test no more than 48 hours prior to arrival (you need to send us proof of a negative test for each guest – please take a picture and email to us).
Rooms are sanitized after each guest.
Please bring your own reusable water bottle to Tioman (we provide water dispensers at the shop, resort and on the boat).
If you or anyone staying in our Tioman Dive Resort (TDR) room with you should test positive for Covid then
- You need to register your positive RTK test on MySejahtera App and isolate for 7 days as per local law
- If this requires an extension of your stay at TDR, then you are liable to cover the room costs accordingly
- You will receive room service meals, ordered from a nearby restaurant. The costs of which will be added to your room bill
- You can order medicine, RTK test kits and other supplies through our staff. The cost of which will be added to your room bill
- We reserve the right to add extra charges to your bill if necessary, i.e. if we have to relocate a guest that was supposed to stay in your room and the guest is asking for a refund. We try to avoid this at all costs.
9. Currency and Refunds
Reservations will be charged in Malaysian Ringgit (MYR). Any deposits or pre-payments will be deducted from the final reservation invoice in the hotel’s local currency.
A refund of a deposit or prepayment, if any, will be subject to the exchange rate applied by your payment card provider at the time of any such refund and may differ from the exchange rate applied at the time such deposit or prepayment was made.
10. No Smoking Policy
We are committed to provide smoke-free rooms to our guests. Smoking is only permitted outside of the room and ashtrays are provided on the balcony.
A room cleaning fee of MYR 200.00 will be charged should we notice that guests have been smoking inside the room.
11. Guarantee Rules
For reservations guaranteed with a credit card at the time of making your reservation, rooms are held until the TDR hotel check-out time on the day following the day of arrival. TDR may authorize the room rate prior to arrival and reserve funds, including taxes, on the credit card to determine the validity of the credit card. Rooms booked with an invalid credit card are subject to immediate cancellation.
In the event that a guest cannot be accommodated due to the TDR overbooking or an unforeseen circumstance, TDR will attempt to accommodate guests, at its expense, at a comparable property in the area for the night(s) for which TDR is unable to accommodate such guests, and will pay for transportation to that property.
You as the guest are liable for any damage caused to the booked room(s) or to TDR premises or property caused by you or any persons in your party during your stay. TDR reserves the right to retain your credit card and/or debit card details and charge or debit the costs as it deem fit to compensate for the caused damage.
14. Guest’s obligations
You agree to the terms and conditions of purchase imposed by TDR. You also agree that you are fully responsible and shall pay for all charges, fees, duties, taxes, assessments and other amounts arising out of your reservation when due.
15. Force Majeure
Neither TDR nor B&J Diving Centre Sdn. Bhd. will be liable for any change or cancellation of any reservation that is caused, in whole or in part, by events, occurrences, or causes beyond our control. Such events, occurrences, or causes include, without limitation, acts of God, terrorist activities, weather, strikes, lockouts, riots, acts of war, pandemics, earthquake, volcanic activity, ash clouds, tsunamis, fire and explosions.
16. Limited Liability and Indemnity
TDR is responsible to provide you the room(s) as booked. Neither TDR nor B&J Diving Centre Sdn. Bhd. are liable for any loss or damage of property belonging to you our your party nor are we liable to any injury or loss of life incurring by you or your party making use of our facilities or services.
You hereby irrevocably agree to indemnify and keep us indemnified against all liabilities, claims, losses and expenses, including any legal fees that may be incurred by your use or misuse of our premises and services.
